Please read these Terms & Conditions before booking your photoshoot. By completing a booking, you agree that you have read, understood and and accepted these Terms & Conditions.
Booking and Payment
No booking fee is currently required. Full payment must be made via Bank Transfer no later than 3 days before your scheduled photoshoot date via Bank Transfer. If payment has not been received by this time, your booking may be cancelled and the date may be offered to another client.
By booking a session involving a person under the age of 18, the parent or legal guardian confirms that they have the authority to consent to the photography and to accept these Terms & Conditions on the child's behalf.
Cancellation Policy
You can cancel or reschedule your booking free of charge up to 3 days before your photoshoot. Cancellations made within 3 days of your photoshoot will incur 20% deduction from your full amount paid to cover loss of availability. If the photographer is unable to attend due to illness, emergency or circumstances beyond my control, they will make every reasonable effort to arrange an alternative date. If this is not possible, then full payment of your session will be refunded. Bad or extreme weather postponements will be considered at the photographer’s discretion, taking into account safety, travel conditions, and the welfare of horses and riders.
Travel
A travel fee will apply for locations more than 20 miles from Bedford, charged at 55p per mile.
Client Arrival Time
Clients arriving late may result in reduced shooting time. The session will still finish at the agreed end time, and no additional time, refund, or compensation will be provided for time lost due to late arrival.
Editing
The photographer will professionally edit all selected images in their own artistic style. This includes colour corrections, exposure, cropping, minor blemish removal, standard retouching. The client acknowledges they are booking the photographer based on this editing style. The photographer does not supply any unedited images or RAW files.
Copyright
All photos remain the copyright of the photographer under the Copyright, Designs and Patents Act 1988. Purchasing images does not transfer copyright ownership. Watermarked preview images remain the property of the photographer and must not be downloaded, copied, screenshot, edited, shared, or otherwise used without written permission. Unauthorised use of any images may constitute copyright infringement and may result in legal action.
Clients are granted a non-exclusive, non-transferable licence to use purchased images for personal, non-commercial purposes. This includes printing, sharing on personal social media, and displaying the images for personal enjoyment. Images must not be edited, altered, heavily filtered, manipulated (including using AI tools), sold, entered into competitions, or used for commercial purposes without the photographer's prior written permission.
Social media and Portfolio use
The photographer retains the right to use images created during the session for promotional and marketing purposes, including but not limited to the photographer’s website, portfolio, social media pages, advertising, competitions, exhibitions, and other promotional materials. Clients who do not wish for their images to be used for marketing purposes must notify the photographer in writing before the photoshoot. This request will be respected and will not affect the quality or service provided.
Galleries
You can access your online gallery for up to 12 months from the date of delivery. After 12 months, galleries may be removed and access cannot be guaranteed. Clients are encouraged to keep their own backups of their purchased photos.
Horse & Rider Safety
Clients remain responsible for the behaviour and welfare of their horse at all times during the session. Clients participate in photoshoots at their own risk. The photographer has the right to end or alter the session if they believe conditions are unsafe. The photographer is not responsible for injury, loss or damage occurring during the session except where caused by the photographer's negligence or where liability cannot be legally excluded. No abuse will be tolerated, including towards horses. The photographer has the right to end the session with immediate effect without refund.
Limitation of Liability
In the unlikely event of camera failure, equipment malfunction, data loss or other technical issues, the photographer will make every reasonable effort to recover, replace or recreate images where possible. If the session cannot be completed due to a technical issue, the photographer will offer a replacement session at a mutually convenient date where possible. If a replacement session cannot be provided, a refund will be considered based on the circumstances and in accordance with applicable consumer rights.
